Logic Supply, Inc. Policies, Terms, and Conditions of Site and SalePlease read the following statement below regarding Logic Supply's terms and conditions of our Web site and related sales. This agreement contains the policies, terms, and conditions that apply to orders and purchases from Logic Supply, Inc. ("Logic Supply") that will be provided to you ("Customer") on all orders and purchases of products ("Products") and systems ("Systems"). By placing an order with Logic Supply, Customer accepts these policies, terms, and conditions. This agreement also contains the policies, terms, and conditions of the Logic Supply website ("Site"). By accessing this Site, you accept these policies, terms, and conditions. These policies, terms, and conditions are subject to change at anytime without notice. PRICING AND PRODUCT POLICIESLogic Supply Products are factory sealed and come with manufacturer warranties, if any. Logic Supply does not sell refurbished Products. Logic Supply is not responsible for any compatibility issues. Consult with Logic Supply or manufacturer before placing an order. Images on Site may not always represent the exact Product(s). Logic Supply holds the right to change prices or discontinue Products at any time without prior notice in order to remain competitive. Any quotations given by Logic Supply will be valid for the period stated on the quotation. PAYMENT POLICY AND TAXESLogic Supply accepts the following payment methods: Visa, Master Card, Discover, American Express and PayPal. Logic Supply may accept International Credit Cards, COD, Check, Purchase Orders and extends terms on a case by case basis. Logic Supply accepts wire transfers on orders over $1,000. Customer is responsible for any applicable sales, use or other taxes or federal, state, or local fees or assessments associated with the order. Customer must claim any exemption from such taxes, fees or assessments at the time of purchase and provide the necessary supporting documentation. Any sales, use, or other applicable tax or fees or assessments is based on the location to which the order is shipped. Due to a warehouse presence in the state of Vermont, Logic Supply is required to levy VT state sales tax on orders delivered within the state. Orders from Canadian customers are subject to customs duties and/or brokerage fees. SHIPPING POLICYLogic Supply will ship anywhere in the U.S. and Canada. With the exception of AFO/APO addresses, we do not ship internationally. Product orders placed before 4 p.m. eastern standard time usually ship the same business day, but this is not guaranteed. System orders require 3–5 full business days for building and testing. Volume orders may take longer. Rush orders for systems require 2 full business days for building & testing and cut-off time is 1pm eastern standard time. Orders can be delayed because of payment, billing, or shipping verification in order to prevent fraudulent credit card transactions. Shipping closes at 4 p.m. eastern standard time. Tracking numbers will automatically be sent to the Customer when the order has shipped. Logic Supply does not process or ship orders on weekends or national holidays. Delivery times are not guaranteed. Logic Supply reserves the right to use an alternative shipping method due to weight restrictions. Shipping charges are nonrefundable. Products purchased or received under these terms and conditions are subject to export laws and regulations of the United States of America. Title to products passes from Logic Supply to Customer on shipment. Title to software will remain with the applicable licensor(s). BACKORDER POLICYProducts marked "Out of Stock" or "Expected" on Site can still be ordered. Credit card charges will not occur until the order is scheduled to ship. In the event that an item ordered is out of stock, Logic Supply will notify Customer and provide updates as necessary. Availability of out of stock items is dependent upon the manufacturer. Logic Supply will not split orders unless the Customer requests a split shipment and provides payment for each shipment. ORDER CHANGING OR CANCELLING POLICIESAll changes or cancellations must occur before the order is processed by the Logic Supply accounting department. Cancellation requests after this time may result in a cancellation fee of 5% on Products and 15% on Systems (excludes any tax charged). Special orders and volume orders of 10 or more units are non-cancelable. Customers may request to make a change to or cancel their order by contacting Logic Supply during business hours. Changes may be processed to orders as long as the total does not exceed the value of the original order. If the total is higher, contact Logic Supply for instructions. RETURN, EXCHANGE, AND REFUND POLICIESNo returns will be accepted without an issued Return Merchandise Authorization number. Unauthorized returns will be refused and returned to sender. To request a refund or repair, fill out a request online or call our Returns department at 802 861 2300. RMA numbers are good for 14 days. Customers are responsible for the cost of shipping the return products to Logic Supply. Logic Supply will use UPS Ground shipping when sending replacement Products and Systems. Shipping is non-refundable. Claims that the Product did not arrive must be made within 14 days after "item shipped" notification. Claims that the Product was damaged upon arrival, shortage, or incorrect product claims, at the fault of Logic Supply or shipping company, must be made within 14 days of shipment. Return for RefundSubject to the exceptions below, components and systems may be returned for a refund within 14 days of ship date. All custom-built systems are subject to a 15% restocking fee. Shipping charges are nonrefundable. Except in the event of a shipping error, customers are responsible for the cost of shipping items back to Logic Supply. The following products are nonrefundable:
Note: Due to the cost of administering returns, all non-U.S. sales are final. RETURN FOR REPAIR OR EXCHANGEIf a Product or System appears to be non-functioning or defective, read this section and contact Logic Supply technical support at 802 861 2300 or send an inquiry to support@logicsupply.com. A Logic Supply technician will contact you to discuss your issue and options. Systems built to order are covered under a one-year limited warranty and extended warranty coverage is available. If the system is under warranty, and the warranty has not been voided, Logic Supply will repair non-functioning systems. Except where noted, components sold by Logic Supply are covered under a one year limited warranty. Customers can either return the product directly to Logic Supply or, depending upon the item, return the product to the manufacturer directly. After 30 days from ship date, Logic Supply will return the product to manufacturer for repair or replacement. The warranty will be void if there is evidence of damage, misuse, or modification by the customer. The warranty does not extend to the following: closeout items, software, and items shipped outside of North America. For warranty repairs, Canadian customers must bear shipping costs to and from Logic Supply and any duties, taxes, or brokerage fees associated with the RMA. When items returned for repair are found to be working or when the warranty has been voided, the cost of shipping back to the customer will be charged to the customer. Prior to sending in computer systems, bare bones products, or hard disk drives for repair, customers should backup all valuable data. CUSTOMER ACCESS, SECURITY AND PRIVACY POLICYCustomers can log into their Logic Supply account at any time to obtain their order status. All online transactions through Logic Supply are processed through our secure server and encrypted with 128-bit technology. Credit card Payments are processed in real time through our payment gateway. Every order is examined by a Logic Supply employee to protect Logic Supply and its Customers from fraudulent transactions. Except at Customer's explicit request, Logic Supply does not retain credit card information. Logic Supply will never share, sell, or rent your personal information. Information provided is used solely for the fulfillment of your order and possible promotional notifications from Logic Supply. The Logic Supply Newsletter provides Customers with product updates, promotions, etc. Customers may unsubscribe to the newsletter at any time. DISCLAIMERSLogic Supply holds the right to accept, decline, refuse, or cancel an order for any reason. Receipt of an electronic confirmation does not signify Logic Supply’s acceptance of order or confirmation of Logic Supply’s offer to sell. Terms of payment are at the discretion of Logic Supply. In the event of incorrect pricing or information due to typographical error, Logic Supply can refuse or cancel the order. In this case, a refund will be issued immediately. Logic Supply reserves the right to make exceptions to these terms and conditions. SITE LINKS AND TRADEMARKSThis Site may contain links to other sites on the Internet that are owned and operated by third parties. Logic Supply is not responsible for the operation of or content located on or through any such site. All product names throughout this Site are trademarks or registered trademarks of their respective holders. All product names and company logos mentioned herein remain the trademarks of their respective owners. LIMITATION OF LIABILITYLogic Supply shall not be liable for lost profits, loss of business or other consequential, special, indirect, or punitive damages, even if advised of possibility of such damages, or for any claim by any third party except as expressly provided herein. Logic Supply shall not be liable for Products, Systems, or services not being available for use or for lost or corrupted data or software. You agree that for any liability related to the purchase of Product, Systems, or services, Logic Supply is not liable or responsible for any amount of damages. The foregoing limitation of liability shall apply whether any claim is based upon principles of contract, warranty, negligence, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose, or otherwise. JURISDICTION AND VENUECustomer agrees that any legal action brought against Logic Supply shall be governed by the laws of the State of Vermont without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Logic Supply Site shall be an appropriate federal or state court located in Vermont. |
